Public Consultations:

Section 117(6)(b) of the Maritime Area Planning Act 2021 sets out the statutory provisions by which MARA should carry out a public consultation where MARA has made a decision that an appropriate assessment is required.

  • A Public Consultation of minimum 30 days for the public to make submissions on the licence application
  • Notice of the Public Consultation will be published in local/national newspapers and on the MARA website
  • MARA may also, during this period, consult with relevant public authorities which MARA believes might have appropriate observations to make on the application
  • MARA will publish associated licence documents on its website
  • MARA must consider submissions in the appropriate assessment

MARA will treat all personal data that a submitter provides in accordance with MARA’s obligations under data protection legislation, including the Data Protection Act 2018 and the EU General Data Protection Regulation (GDPR). A Privacy Statement explaining how MARA, as the Data Controller, will process the personal data, how that information will be used and what rights the submitter may exercise in relation to its personal data, is available on our Privacy Policy page.

Data Protection Notice: By making a submission, you acknowledge that the information provided will be processed, retained and may be published by MARA as part of the MUL process, in the performance of its statutory functions under the MAP Act. This processing is carried out in accordance with Article 6(1)(e) GDPR (task carried out in the public interest). Published material may include the name of the submitter.

 

Open Public Consultations

Please note that the validity of a MAC or MUL Determination may be questioned by Judicial Review under Order 84 of the Rules of the Superior Courts (S.I. No 15 of 1986) in accordance with Chapter 13, Part 4 or Chapter 8, Part 5 of the Maritime Area Planning Act 2021. Any application for leave to apply for judicial review must be made promptly and in any event within eight weeks of the date of the notice. Practical information on Judicial Review can be obtained from the Citizens Information Board, Ground Floor, George’s Quay House, 43 Townsend Street, Dublin 2 (Citizens Information Board website) or from the Courts website.

Closed Consultations
