The deadline for applying for a MAC in accordance with Section 75A(1) is 17th<\/sup>\u00a0July 2024 and, applicants are reminded to ensure completed applications accompanied by the specific fees need to be submitted before the deadline.<\/p>\n Section 278 of the Historic a nd Archaeological Heritage and Miscellaneous Provisions Act 2023 amends the Maritime Area Planning Act 2021 (the Act) by the insertion of Section 75A relating to when a MAC is required after the grant of certain development permission.\u00a0 Section 75A(1) specifies that:<\/p>\n \u201cwhere development permission has been granted, on or before 17 July 2023, for a proposed maritime usage in a part of the maritime area, a person shall not undertake such usage unless he or she is, in respect of that part, the holder of a MAC for the occupation of that part for the purposes of such usage.\u201d<\/p>\n Section 75A(1) does not apply where the proposed maritime usage is subject of a foreshore lease or licence.<\/p>\n MARA would like to take this opportunity to advise you that we can provide certainty in relation to timeframes for the processing and determination of MAC applications.\u00a0 MARA aims to determine MAC applications not later than 90 days after the day on which it is satisfied that the applicant has complied with all the requirements in relation to the application.<\/p>\n Application under Section 75A of the Act must be made before 17 July 2024. Where such an application is not made before this date, then an application would require to be made under Section 75 of the Act (i.e. when MAC is required prior to seeking development permission) and a new application for planning permission may be required.<\/p>\n MARA would be happy to accommodate pre-applications to provide guidance and address any queries in relation to the MAC application process. Any such request for a pre-application would be prioritised and facilitated at the earliest opportunity.<\/p>\n
